Supported Living- are you correctly registered?

CQC have issued new guidance on the registration of supported living services. It can be downloaded from their website, www.cqc.org.uk. If you are running supported living services, we strongly advise that you read and review this guidance as its publication may be an indication that CQC intend to look at this issue closely in the coming months. It is important that you are correctly registered, as under the Health and Social Care Act 2008, providers commit an offence if they are not registered for regulated activities which they carry on.

Providers of supported living services should be registered for either (i) accommodation together with personal or nursing care or (ii) personal care. If you are providing both accommodation and personal care to your service users, but are only registered for personal care, you should review your service against this guidance to check whether you are correctly registered. Unfortunately it is not black and white and CQC list a number of indicators which they will take into account when considering whether you are correctly registered.

If you are operating supported living services, considering setting up a new service or de-registering a care home, and you would like some advice on this guidance, please do get in touch with Hazel Phillips on 0117 930 8478 or hazel.phillips@qsbdlaw.com for further information.
